IMPORTANT HOW TO VALIDLY EXERCISE THE RIGHT OF WITHDRAWAL
Pursuant to the applicable legislation and the Conditions of Sale accepted by you at the time of purchase, the exercise of the right of withdrawal is subject to the following conditions:
1) Within 28 (twenty-eight) days of receipt of the product being returned, this form, correctly completed, must be sent by e-mail to customercare@displaj.it If the Products have been shipped by
the Seller (DISPLAJ), this form the latter will send the "Return Code" via e-mail.
2) Within 14 (fourteen) days from the date on which you notified the Seller of your decision to withdraw from the contract, it is necessary to transcribe the "Return Code" in this form and deliver the
product / s to be returned, together with this form complete with "Return Code", to DI. PEN. s.r.l. at the address in Via Castelgandolfo, 14 cap. 80013 - Casalnuovo di Napoli (NA) ITALY, or to the carrier in
charge of the return indicated by the Seller (DISPLAJ). If the return is sent back using a different courier, all costs will be borne by the customer.
3) If multiple products are returned, they must be returned to DI. PEN. s.r.l. at the same time and / or with the same shipment.
It is also necessary that:
a) the product is intact and complete with the security thread present on the items;
b) the product is returned in its original packaging;
c) each item must be returned with all labels and tags attached, including all original packaging and accessories (dustbags, hangers, clothes covers, etc.) received with the order;
d) the garments must not have been worn, washed or altered and must not show any signs of use;
e) the items must be properly packed, in the same way they were received;
f) the return is accompanied by the form referred to in point 1, complete with the "Return code". Against the legitimate exercise of the right of withdrawal, DISPLAJ will refund the price of the returned
product, including the cost of the first shipment, within 14 (fourteen) days.
g) returns authorized by DISPLAJ must be shipped from the same country in which the original order
was delivered.

RIGHT OF WITHDRAWAL
In accordance with art. 52 of the Legislative Decree 6 September 2005 n. 206 (the "Consumer Code"),you have the right to withdraw from the contract signed with DI. PEN. s.r.l. (the "Seller" or "DISPLAJ") without any penalty and without giving any reason, within 28 days from the day you received theproducts purchased on displaj.it. In accordance with art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following methods:
a) online transmission to the Seller via email: customercare@displaj.it of the Return Form that you find attached, completed in full; in this case, the Seller will send you confirmation by e-mail that the
declaration of withdrawal has been received;
b) sending by post to the Seller in accordance with the standard form pursuant to art. 49, paragraph 4, of the Consumer Code, to be completed in full;
c) sending by post to the Seller another explicit declaration of your decision to withdraw from the contract. In cases b) and c), your declaration must be sent to the attention of the Customer Service at:
DI. PEN. s.r.l. at the address in Via Castelgandolfo, 14 cap. 80013 - Casalnuovo di Napoli (NA) ITALY in such cases, you will be responsible for proving the correct and timely exercise of the right of
withdrawal.
In accordance with art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from
the date on which you notified the Seller of your decision to withdraw from the contract.
1. Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer Code The right of withdrawal is exercised correctly if the following conditions are fully respected: a) the
right of withdrawal must be regularly exercised within twenty-eight (28) days of receipt of the products by following one of the methods indicated above;
b) the products must comply with the requirements indicated in art. 3 and must not have been used, worn and washed;
c) the identification tag must still be attached to the products with the disposable seal which is an integral part;
d) the product is returned in its original packaging;
e) each item must be returned with all labels and tags attached, including all original packaging and accessories (dustbags, hangers, clothes covers, etc.) received with the order;
f) the garments must not have been damaged and must not show any signs of use;
g) the items must be properly packed, in the same way they were received;
h) the return is accompanied by the return form and complete with the "Return Code" received from DISPLAJ.
i) returns authorized by DISPLAJ must be shipped from the same country in which the original order was delivered.
l) the returned products must be delivered to the shipper within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract;
If you have complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will refund you in full the price of the products purchased, remaining at your expense
only for the return costs, i.e. those for returning the purchased products to the Seller, unless the Seller has expressly exempted you from such expenses to the at the time of purchase and on the additional
condition that you use the forwarder and the shipping methods suggested by the Seller in the following paragraph.
2. 2. Methods of returning the products to the Seller
The Seller suggests using the GLS forwarder (https://www.gls-italy.com/) to return the purchasedproducts. If you decide to use GLS for shipping and use the "Return Code" label containing the return
address - included in the package containing the purchased products, you will not have to pay the return costs in person. In fact, the Seller will pay the courier on your behalf, withholding from your refund a lump sum equal to the cost previously incurred for the delivery of the purchased products to your home. This shipping method also allows you to check, at any time, where each package is, freeing
you from any responsibility in case of loss or damage to the products during transport. If, on the other hand, you decide to use a forwarder other than GLS, you will have to pay the costs of the return in
person and you will be responsible for any loss or damage to the products during transport. It is understood that, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs
incurred by you for choosing a different and / or faster type of shipment and delivery than the standard one will not be reimbursed.
3. Conformity checks of returned products
You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in art. 1 or in the hypothesis referred to in art. 59 of the Consumer Code and you can choose to
have the purchased products back at your expense. If you refuse this shipment, the Seller reserves the right to keep the products and the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products, as well as their packaging, accessories
and documentation. The Seller reserves the right not to accept the return or to reduce the amount of the refund or exchange with another item if the product shows signs of use or if it has been used or
altered from its original condition. The Seller may make a reduction in the refund in the following circumstances: • the products have been used, worn, damaged or washed; • the identification tag is no longer attached to products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; • the original packaging which is an integral part of the product (eg the protective bag) has not been returned; You will be contacted if the Seller decides to reduce the refund. In this case, you can choose, as an alternative to the reduction of the refund, to have the purchased products back at your expense. In the latter case, if you refuse the shipment, the Seller will have the right to withhold the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products. The Seller assumes no responsibility in the event of products returned by mistake.
4. Refund times and methods
After the Seller has received your return and checked that all the requirements have been met, you will receive an e-mail confirming acceptance of the return and DISPLAJ will proceed with the full refund,
or, if it is found that there is a decrease in the value of the returned products, you will receive an e-mail in which you will be informed of the amount deducted by way of deduction of the refund and DISPLAJ will proceed to refund the amount due. Whatever payment method you use among those available, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which you became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal has taken place in compliance with the above conditions. The actual time for crediting or returning the sums you paid for the purchase of the products depends on the payment methods used: • purchase via PayPal the refund will be made to your PayPal account and will be immediately visible. The actual refund on the credit card from your PayPal account depends on the institution that issued the card; • purchase by credit / debit card: the repayment time depends on the credit / debit card management company We remind you that the value date of the re-credit is the same as the debit date; • cash on delivery (if available): the refund takes place on the current account indicated by you,
therefore the refund time depends on the correctness of the data you enter; the re-credit normally takes place within fourteen (14) days. In the event of a gift, the refund of the sums will be made to the
person who made the payment.
5. Products affected by defects or non-compliant
Without prejudice to the application of the mandatory rules for consumer protection, you can return a product because it is affected by defects or does not comply with the order, informing the Seller,
within twenty-eight (28) days from the day you received the products purchased on WWW. DISPLAJ.IT using the Return Form found in the Customer Service area. DISPLAJ may reserve the right to request photographic evidence before authorizing returns for defective goods. For how to return products, check sections 1 and 2.
DISPLAJ will verify the products that you have returned because they are affected by defects or do not conform to the order and will proceed with the full refund, including the shipping costs and the
expenses you have incurred to return the products to DISPLAJ. In the event that DISPLAJ does not detect any defect or lack of conformity in the returned products, you will be informed that your return will not be accepted and you can choose whether to have the purchased products back. If you refuse the shipment, DISPLAJ will have the right to keep the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.
6. Conditions for exchanging products
In some cases, as specified below, you will have the possibility to change the products purchased with others of the same model, with different size and / or color. The exchange of products will be possible
only if the products in the selected size and / or color are available at the Seller's warehouses. The exchange request will take place within the following limits:
a) you can request the exchange of one or more products purchased no later than twenty-eight (28) days from the date of their delivery, by completing the Return Form, to be sent to DISPLAJ via email: customercare@displaj.it within the aforementioned term. The products to be changed must be delivered to the courier within fourteen (14) days from when you notified the Seller of your decision
to change the products;
b) you can request the exchange of one or more products purchased only with products of the same model, with different size and / or color. In any case, the options available for the exchange will be
indicated in the Return Form;
c) you can make only one exchange request for each product purchased;
d) the products for which you request the change must be returned to DISPLAJ in their original packaging, unused, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;
e) the products to be exchanged that are part of a single order must be sent to DISPLAJ in a single shipment.
f) the products must comply with the requirements indicated in art. 3 and must not have been used, worn and washed;
g) the identification tag must still be attached to the products with the disposable seal which is an integral part;
h) the products to be exchanged must be returned in their original packaging;
i) each item must be returned with all labels and tags attached, including all original packaging and accessories (dustbags, hangers, clothes covers, etc.) received with the order;
l) the items must be properly packed, in the same way they were received;
m) the exchange is accompanied by the return form and complete with the "Return Code" received from DISPLAJ. If all the aforementioned conditions are correctly respected, once the Return Form containing your exchange request has been completed and sent, DISPLAJ will process the same exchange request by sending you a confirmation e-mail for this purpose. After DISPLAJ has received the products you intend to change and checked that all the above requirements have been met, DISPLAJ will check the actual availability in its warehouses of the products in the size and / or color you have selected. In the event that the product or products selected for the exchange are not available in its warehouses, DISPLAJ will not be able to accept your exchange request and will therefore proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with what provided for by the Consumer Code and in the manner provided above. In the event that the product or products selected for exchange are available, DISPLAJ will be able to accept your exchange request and will therefore proceed to send you an e-mail confirming the shipment of the replacement products. In this case, the shipment
will take place within thirty (30) working days from the date on which DISPLAJ becomes aware of your exchange request. Shipping costs for replacement products will be borne by DISPLAJ. Where the price of the purchased product is lower or higher than the price of the product selected for the exchange, you will not be entitled to any refund and / or charge for the difference. However, it is understood that, as an alternative to the request for product replacement, you can exercise your right of return in accordance with the Consumer Code. You will be contacted if your exchange request cannot be accepted because it does not comply with the above conditions. In this case, you can choose to get back the products you intended to exchange at your expense. If you refuse this shipment, DISPLAJ reserves the right to withhold the products and may also withhold the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products, as indicated above. The replacement product or products may be subject to subsequent return pursuant to art. 52 of the Consumer Code.
7. Product identification tag
We remind you that all the products offered for sale by the Seller are equipped with an identification tag attached with a disposable seal, which is an integral part of the good. We therefore remind you to
try the product without removing the tag and its seal, because returned products that do not have them will not be accepted.
8. Consumer Code
These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by Legislative Decree 6 September
2005, n. 206.
